General Terms and Conditions
1) Scope of Application
1.1 These General Terms and Conditions of the company Eisbach Riders (hereinafter referred to as “Seller”) apply to all contracts concluded between a consumer or a trader (hereinafter referred to as “Client”) and the Seller relating to all goods and/or services offered in the Seller’s Shopify-based online shop (www.eisbach-riders.com). The inclusion of the Client’s own terms and conditions is hereby rejected unless otherwise agreed.
1.2 Our online shop is intended exclusively for consumers. A consumer is any natural person who concludes a legal transaction for purposes that are predominantly not related to their commercial or self-employed professional activity. A trader is a natural or legal person or a partnership with legal capacity who, when concluding a legal transaction, acts in the exercise of their commercial or independent professional activity.
1.3 Digital content in the sense of these Terms and Conditions means all data not on a tangible medium which are produced in digital form and are supplied by the Seller by granting certain usage rights as defined herein.
2) Conclusion of the Contract
2.1 The product descriptions in the Seller’s online shop do not constitute binding offers by the Seller but serve as an invitation to submit a binding offer by the Client.
2.2 The Client may submit the offer via the Shopify checkout system integrated into the Seller’s website. After placing the selected goods and/or services in the shopping cart and completing the checkout process, the Client submits a legally binding offer by clicking the “Pay now” (or equivalent) button.
2.3 The Seller may accept the Client’s offer within five days:

by sending a written order confirmation (e-mail is sufficient);

by delivering the ordered goods to the Client; or

by requesting payment after the order has been placed.
If several of these alternatives apply, the contract shall be concluded when one of them occurs first. If the Seller does not accept the offer within the stated period, this shall be deemed a rejection of the offer.
2.4 If the Client chooses a payment method integrated via Shopify Payments, payment processing is handled by the payment service provider Shopify Payments (operated by Stripe Payments Europe, Ltd.), subject to the applicable terms of Stripe/Shopify. Other payment providers such as PayPal, Klarna, Sofortüberweisung, Apple Pay, or Google Pay may also be available, in which case their respective terms of service apply.
2.5 The contract text is stored securely by Shopify. The Seller shall provide the Client with a copy of the order details and these Terms and Conditions by e-mail after the order has been submitted.
2.6 Prior to submitting a binding order, the Client can identify and correct input errors using the on-screen information and the usual keyboard and mouse functions.
2.7 The contract is concluded exclusively in German. Order processing and communication usually take place via e-mail and automated systems. The Client must ensure that the provided e-mail address is correct and that messages from the Seller or Shopify can be received.
3) Right to Cancel
3.1 Consumers are entitled to the statutory right of withdrawal.
3.2 Detailed information on the right of withdrawal is provided in the Cancellation Policy available on this website.
4) Prices and Payment Conditions
4.1 Unless otherwise stated, all prices include the statutory value-added tax (VAT). Delivery costs, if applicable, are displayed separately during checkout.
4.2 Payment can be made using one of the methods available in the Seller’s online shop. These may include Shopify Payments, PayPal, Klarna, Sofortüberweisung, Apple Pay, Google Pay, or other integrated payment methods displayed during checkout.
4.3 If prepayment by bank transfer has been agreed upon, payment is due immediately after conclusion of the contract.
4.4 For payments processed via third-party payment providers (e.g. PayPal, Klarna), the respective provider’s terms and conditions apply. The Seller remains responsible for customer service, delivery, returns, and complaints.
5) Shipment and Delivery Conditions
5.1 Goods are delivered to the delivery address provided by the Client during the Shopify checkout process. The delivery address stated in the order confirmation is decisive.
5.2 We deliver to EU, Switzerland and Canada.
Shipping costs are displayed during checkout. Delivery is carried out through reliable shipping and fulfillment partners.
5.3 Should delivery fail and goods be returned to the Seller due to the Client’s fault (e.g. undeliverable address or failure to collect), the Client bears the costs of reshipment. This does not apply if the Client effectively exercises the right to cancel or if delivery failure is beyond the Client’s control.
It is the Client’s responsibility to ensure that all delivery information is accurate before completing the order.
5.4 Personal collection of goods is not possible for logistical reasons.
6) Reservation of Proprietary Rights
The Seller retains ownership of the delivered goods until full payment of the purchase price.
7) Warranty and Transport Damage
7.1 Statutory provisions apply to defects in the goods.
7.2 For used goods, claims for defects that arise more than one year after delivery are excluded. Claims for defects within one year follow the statutory limitation period. This does not apply if the Seller fraudulently concealed the defect, or if damages or construction defects are involved.
7.3 Any additional manufacturer’s warranties offered are stated on the respective product page or included in the product packaging.
7.4 If goods are delivered with obvious transport damage, please report such defects immediately to the delivery company and notify us without delay. Failure to do so will not affect your statutory rights but helps us assert claims against the carrier or transport insurance.
8) Applicable Law
The law of the Federal Republic of Germany shall apply, excluding the UN Convention on Contracts for the International Sale of Goods (CISG).
For consumers, this choice of law applies only insofar as it does not deprive them of the protection granted by mandatory provisions of their country of habitual residence.
9) Alternative Dispute Resolution
9.1 The EU Commission provides an online dispute resolution platform: https://ec.europa.eu/consumers/odr.
9.2 The Seller is neither obliged nor willing to participate in a dispute settlement procedure before a consumer arbitration board.
10) Liability
The Seller’s liability for damages shall be unlimited in cases of intent or gross negligence, for injury to life, body, or health, or under the Product Liability Act.
For simple negligence, the Seller is liable only for damages resulting from the breach of essential contractual obligations (cardinal duties), limited to the foreseeable, typical damage.
Further claims for damages are excluded.
